A New Jersey, USA, federal judge has tossed a qui tam lawsuit accusing Bayer Corp. and Johnson & Johnson of defrauding federal insurance programs through antibiotic labeling shortfalls, ruling that the complaints need more specifics in order to advance, according to Law360.
Whistleblower Charles Bennett’s complaint “contains hardly any facts” regarding his claims that the companies made misrepresentations about Bayer’s Cipro (ciprofloxacin) and J&J’s Levaquin (levofloxacin) to the Food and Drug Administration or withheld safety information, Judge Esther Salas of the US District Court for the District of New Jersey said in a non-precedential opinion.
