US court invalidates Zytiga patent

A US administrative court has invalidated a US healthcare giant Johnson & Johnson’s (NYSE: JNJ) patent on its blockbuster cancer drug Zytiga (abiraterone acetate), bringing rivals closer to selling generic versions.

The Patent Trial and Appeal Board said a Johnson & Johnson patent describing a method of administering Zytiga should not have been granted because the process it described was obvious.

Generics drugmaker Argentum Pharmaceuticals challenged all claims (claims 1−20) of J&J subsidiary Janssen's US Patent No 8,822,438, which the Orange Book states will expire in August 24, 2027.
