The Pharmaceutical Research and Manufacturers of America (PhRMA) is continuing its legal challenge against the US government’s drug pricing reforms.
The trade body has taken its case to the Fifth Circuit Court of Appeals, taking aim at key provisions in President Joe Biden’s Inflation Reduction Act (IRA), arguing that the legislation violates due process protections under the Fifth Amendment.
The challenge comes after a district court earlier this year dismissed PhRMA’s initial complaint, citing procedural issues.
